Privacy Policy

This Privacy Policy explains how Quantum Spike Digital (“Quantum Spike Digital,” “QSD,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit our website, become a client, or interact with marketing campaigns, booking systems, and follow-up communications we operate. We serve businesses and consumers primarily in the United States, and this policy reflects U.S. federal and state privacy law.

1. Scope & our role

This policy applies to quantumspikedigital.com, the lead-capture forms, landing pages, advertising campaigns, AI booking and follow-up systems we build and operate, and any related calls, text messages, and emails.

Quantum Spike Digital acts in two roles:

  • As a business / controller — for information about our website visitors, prospective clients, clients, and personnel.
  • As a service provider / processor — when we build and run client-acquisition systems on behalf of our business clients. In those cases we process consumer “lead” information under our client’s instructions and pursuant to a written services agreement. The relevant client is the business responsible for that data, and consumers should also review that client’s own privacy notice.

If a specific campaign or landing page presents a different or supplemental privacy notice, that notice governs for that campaign.

2. Information we collect

We collect the following categories of personal information, depending on how you interact with us:

We do not intentionally collect Social Security numbers, government ID numbers, precise geolocation, biometric data, or health information. We ask that you not submit such “sensitive” information through our forms. We do not knowingly collect information from children (see Children’s privacy).

3. How we collect information

  • Directly from you — when you submit a form, request a quote, book a call, reply to a message, or email or call us.
  • Through advertising platforms — lead forms and conversions from Meta (Facebook/Instagram), Google, YouTube, and TikTok campaigns we run.
  • Automatically — through cookies, pixels, tags, and server logs when you visit a page (see Cookies & tracking).
  • From our clients — when a business engages us to manage or migrate its marketing and CRM data.
  • From service providers — analytics, CRM, telephony/SMS, and fraud- or consent-verification vendors that support our systems.

4. How we use information

  • To provide, operate, and improve our marketing systems, booking, and follow-up services.
  • To respond to inquiries, schedule appointments, and contact you about a service you requested.
  • To run, measure, and optimize advertising campaigns and to build look-alike and retargeting audiences (where permitted and where you have not opted out).
  • To verify and document consent for calls, texts, and emails.
  • To process payments and manage client engagements.
  • To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
  • To comply with legal obligations, including TCPA, CAN-SPAM, and applicable state privacy laws, and to enforce our agreements.

5. Cookies & tracking technologies

We and our partners use cookies, web beacons, pixels, and similar technologies for essential site functionality, analytics, and advertising. This includes tools such as the Meta Pixel, Google Analytics, and Google/Meta advertising and conversion tags, which help us understand traffic and measure ad performance.

6. How we share information

We disclose personal information only as described here:

  • Service providers / processors — hosting, analytics, CRM, telephony and SMS, email delivery, payment, and consent-verification vendors that process data on our behalf under contract.
  • Advertising & measurement partners — Meta, Google, and similar platforms, for campaign delivery, conversion tracking, and audience building.
  • Our clients — when we generate a lead or run a system for a business, the qualifying lead information is provided to that client.
  • Professional advisors — lawyers, accountants, and auditors as needed.
  • Business transfers — in connection with a merger, acquisition, or sale of assets.
  • Legal & safety — to comply with law, respond to lawful requests, or protect rights, property, and safety.

We do not sell your personal information for money. However, our use of advertising and analytics partners (such as Meta and Google) for cross-context behavioral advertising may be considered a “sale” or “sharing” under the California Consumer Privacy Act and similar state laws. 7. Calls, texts & email — TCPA & CAN-SPAM

Because we operate appointment-booking and follow-up systems, we and our clients may contact you by phone, text message (SMS), and email — but only consistent with U.S. law.

Phone calls & text messages (TCPA)

By providing your phone number and agreeing to be contacted, you give prior express written consent to receive calls and text messages — including via automated technology or prerecorded/artificial voice — at the number provided, for the marketing and scheduling purpose described. Consent is not a condition of any purchase. Message frequency varies; message and data rates may apply. You can revoke consent at any time — reply STOP to cancel texts or HELP for help. Email (CAN-SPAM)

Our marketing emails identify the sender, include a valid physical mailing address, and provide a working unsubscribe link. We honor opt-out requests promptly. To stop marketing email, use the unsubscribe link or email privacy@quantumspikedigital.com.

We offer campaigns in English and Spanish; consent and opt-out apply in the language used to communicate with you.

8. Your U.S. privacy rights

Depending on your state of residence, you may have some or all of the following rights regarding your personal information:

  • Right to know / access the categories and specific pieces of personal information we hold about you.
  • Right to correct inaccurate personal information.
  • Right to delete personal information we have collected, subject to legal exceptions.
  • Right to data portability — a copy in a portable, usable format.
  • Right to opt out of the sale or sharing of personal information and of targeted/cross-context behavioral advertising.
  • Right to limit the use of sensitive personal information (where applicable).
  • Right to opt out of profiling in furtherance of certain automated decisions (where applicable).
  • Right to non-discrimination for exercising your rights, and the right to appeal a decision on your request.

These rights are provided to residents of states with comprehensive privacy laws, including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Indiana, Tennessee, New Jersey, New Hampshire, Minnesota, Maryland, and others as those laws take effect.

How to exercise your rights

We will verify your identity before responding and will reply within the timeframe required by law (generally 45 days, extendable once where permitted). An authorized agent may submit a request on your behalf with proof of authorization. We will not discriminate against you for exercising any right.

9. California notice (CCPA/CPRA)

For California residents, in the preceding 12 months we have collected the categories of personal information described in Section 2 (identifiers, contact and commercial data, internet activity, communications, professional information, and inferences). We collect this information from the sources in Section 3, use it for the purposes in Section 4, and disclose it to the recipients in Section 6.

We do not sell personal information for monetary consideration and we do not knowingly sell or share the personal information of consumers under 16 years of age. We may “share” identifiers and internet activity for cross-context behavioral advertising; you may opt out below. We retain personal information as described in Section 11. You may designate an authorized agent and you have the right to appeal.

We keep personal information only as long as necessary for the purposes described here, including to provide services, maintain consent and suppression records (required for TCPA and CAN-SPAM compliance), meet legal and tax obligations, resolve disputes, and enforce agreements. When information is no longer needed, we delete or de-identify it.

We use administrative, technical, and physical safeguards designed to protect personal information — including access controls, encryption in transit, and vetted vendors. No system is perfectly secure, so we cannot guarantee absolute security, but we work to protect your information and to notify affected parties and authorities of incidents as required by law.

13. Children’s privacy

Our website and services are intended for businesses and adults. We do not knowingly collect personal information from children under 13 (or under 16 where applicable), consistent with the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided us information, contact us and we will delete it.

14. Visitors outside the United States

Our services are directed to the U.S. market. Your personal information may be processed in the United States and in other countries where we or our service providers operate. By using our website or services, you understand and consent to this processing. If you are in the EU/UK and believe a campaign we operate processes your data, contact us and we will address your request consistent with applicable law (including GDPR/UK GDPR data-subject rights, where they apply).
